Numerous television and speaking engagementsEnfamil And The Possible Links With Bacterial Infection
An experienced Los Angeles injury lawyer will tell you that wrongful death in any form is a particularly difficult and trying case for an attorney to handle, but it is made that much harder when it is an infant or young toddler. One of the most recent causes of toddler death was caused through ingestion of a type of newborn baby formula known as Enfamil.
In January a ten-day-old baby who hailed from Lebanon Missouri died after supposedly contracting a very rare bacterial infection. Tests by specialists at the local hospital found that the cause of the death was due to the Cronobacter Sakazakii bacteria. The bacteria is typically found in dried milk powder and is also often present in wheat and rice. According to the Center for Disease Control (CDC) they suggest that this type of bacterial disease is extremely rare and as a result only affects between 4 and 6 people every year. However this is clearly not very reassuring to the family of the victim.
In the meantime Walmart who supply the formula in their stores have removed it from over 3000 of their branches and a team of injury attorneys Los Angeles have also noted that other retailers such as Kroger Co, Safeway, Walgreen Inc and Supervalu Inc have also been quietly pulling this product from the shelves.
This is not the first incident of its kind this year that has been linked to Enfamil and earlier on last month another toddler also from Missouri contracted the Cronobacter Sakazakii virus, but miraculously managed to make a full recovery. The FDA are advising people that they should not be unduly alarmed and that tests are still taking place on the product. But nonetheless the withdrawal from the shelves by large retailers is definitely damaging for the product makers 'Mead Johnson Nutrition'.
The manufacturers of the product state that they have conducted their own private tests on the same batch as was purchased by the parents of the 10-day-old child who died, and they in fact found zero trace of the bacteria in several separate samples taken. At present they are fighting the claims that the bacteria was present in any of their products.
A Los Angeles injury attorney explains that a wrongful death claim is totally different from any other type of personal injury lawsuit. The reason for this is that in any other type of case, the compensation claimed can be due to immediate and ongoing medical expenses, loss of wages, possible loss of future wages (if applicable) and any stress and anguish caused to the victim. In a wrongful death case, the injured party is clearly no longer with us and as a result the claim is geared more towards helping the family. Therefore compensation for funeral and burial expenses, loss of companionship or a loved one, pain and suffering caused to the family and any loss of inheritance can all be brought into consideration.
When it comes to representation, a skilled team of Los Angeles injury attorneys will have the experience and the knowledge necessary to take on such a case and as a result will be able to deliver full and fair compensation as quickly and as painlessly as possible. An attorney understands that although financial compensation can in no way bring back a loved one, it can go some way in helping to heal the family members and speed up the grieving process, this is why a good lawyer will go for maximum compensation every time.
There have been many cases similar to that of Enfamil and the FDA may well have only just scratched the surface of the problem. Only time will tell if the product has been given the 'all clear' or that more cases will come to light. If the latter is the case, then it is somewhat reassuring to know that there is a skilled Los Angeles injury lawyer and their team standing by who are well versed in dealing with such issues and have the resources necessary to take on the large companies whilst striving to deliver the compensation that the client deserves.
