Ski Resort Accidents and Who Is Responsible

Unfortunately ski resort accidents are all too common and many people think that coming away with a few bumps and bruises after a week on the wrist is par for the course, and indeed this is probably the case. However what happens if you end up in hospital during a ski holiday because of an accident that you believe was not your fault, then who is to blame? A team of Riverside personal injury attorneys explain:

Although snowboarding and skiing are favorite pastimes for people they don't come without risk. More often than not people are travelling downhill at a fair rate of knots often with limited protection. There can be so many ways in which an accident can occur. Another skier or snowboarder could come crashing into you knocking you flying and causing injuries such as broken bones or possibly head trauma. It could be that jumps and obstacles on advanced ski runs aren't maintained properly and accidents occur, or it could be that areas that are dangerous to ski haven't been marked as out of bounds or have been marked up but it isn't particularly clear. A faulty ski lift that should have been checked could be another cause of an accident.

As you can see it's not just about your skiing/snowboarding abilities. In fact you could be the best skier in the world but you have no control of other people or any undue hazards that lie on the slopes. In reality the ski resort owners have a duty of care to make sure that every single snowboarder or skier is as safe as possible and that they enjoy the resort. By law they should also have certain safety measures in place should someone have an unfortunate accident, in that they need to be able to provide immediate first aid whilst awaiting the ambulance services

In the result of a ski or snowboarding related fall accident that you feel was through no fault of your own then clearly the first thing that you should do is to seek medical advice. Whilst you are recovering from your injuries and the incident is still fresh in your mind it is important that you try to document exactly what happened. Try to get names of witnesses and write down what you remember about the incident. It might at this stage pay you to contact a lawyer. A skilled team of Riverside personal injury attorneys will offer a no obligation consultation where you can talk through what happened and from this they can decide as to whether you have a case to answer. You can also get any questions or concerns that you may have about the case answered. A good attorney will also put you at ease and will keep you informed about how the case should be fought.

Upon making your choice of attorney, the right lawyer will have the financial backing to be able to call upon a whole host of experts who can help to look into your case. People such as product safety testers (if there is an issue with any of the skiing gear that caused your accident), accident investigators, ski equipment experts and health and safety advisers can all help to find where the negligence lies. From this, the team will present their findings back to the lawyer who can look to build a case for the plaintiff.

If findings suggest that you are partly to blame for the accident, then a skilled team of Riverside County personal injury lawyers will explain that you may still be entitled to damages under 'comparative law'. This is when the amount in damages awarded is 'comparative' to the fault of the client. An example of where this law could be used is when another skier has collided into you travelling way too fast, however you might have been skiing in an area that was out of bounds. In this instance the jury decides that you were 30% to blame for the accident. In this case then you would receive 70% of the total amount of damages awarded for this type of accident.

Winter sporting activities are great fun provided that care is taken to be safe. However if you have taken all due care and attention and are injured because of another party's negligence, then a team of Riverside Personal injury attorneys are standing by to help.
